turned down for dla Options

Hi everyone, I tried to claim for dla earlier this year (april) and they have finally decided after a bit of pushing from me that Im not entitled. Ive yet to receive the letter explaining why. I know I work part time but does this automatically disallow me? Ive noticed from the prevous threads that many people dont get it on the first attempt but then do at appeal? Am I wrong in trying to claim this benefit, should I just leave it?

Hi Heather,

Sorry you`ve been turned down for DLA, but working part-time does not have any bearing on whether you get it or not, or even working full-time, come to that. It seems they turn down people`s first attempt automatically , but of course you are not wrong in trying to claim it!

There are people who can help you to fill in your forms, such as CAB. If you have a look at Carol`s thread ( Tabbycat ) there is a lot of info on there about applications and appeals.

Work doesn't come into the equation at all heather and i firmly believe that a lot of claims are turned down because they know that most of us aren't well enough to cope with the hassle of reapplying. I thinks it's important to appeal.

Good luck with the appeal Heather.
Emphasise the hands if you have problems slicing/ chopping and holding heavy dishes when preparing a meal. That way you will at least get the low care component, which is better than nothing!

Definitely appeal the decision and if that fails, go to a tribunal. I can't praise Benefits & Work website enough for their downloadable guides to claiming DLA and other benefits. I'm sure its thanks to using their methods of completing the claim form that I was awarded full DLA in just 8 days.

Whilst you're waiting for the reasons why you were turned down, could you be looking at your application form again (hopefully you kept a copy) and see if there's any more info you could have included? As an example, I enclosed 9 additional type written pages to give a potted 39 year history to support my application, some parts were repeated, but don't worry about that as that's the way the form has been drafted. The important thing is to make the form fit your RA & any other health conditions, rather than trying to make your health condition fit their form. Also if some of the tick boxes don't fit your situation, don't tick any of the boxes but explain in detail on additional sheets.

If you haven't done so already, ask your GP, physio, O.T., carer, Rheumatologist, Surgeon, employer, ex-employer, friend or family member, basically anyone else that knows you well to write a letter or report in support.

The more info you give to show the assessor how RA symptoms (and any other conditions) affects you, what drugs you take, effects of drugs, how often you see health professionals, what tests you've had, whether you've seen a surgeon to discuss surgery options, had surgery, the outcome of that surgery, etc. etc., its less likely you'll be asked to have a medical, asked for more information, or a visit from Social Security etc. Plus, the more detail you give, the less likely a Tribunal will be able to turn you down.

sorry to hear you didn't get dla ,you must appeal, it's people like us that need this,alwys remember yr worst days,when you appeal,and the uncertanty of R.A ,I work part time ,DLA is not a means tested bennifit so you can work.
